1. Acceptance of Terms

By accessing and using My Hero ("the Platform"), operated by My Apps UK, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

My Hero is an online marketplace that connects buyers and sellers of comic books, action figures, collectibles, and related superhero memorabilia. We facilitate transactions but are not party to the actual sale between users.

3. User Accounts

3.1 Registration

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You must not share your account credentials with others

3.2 Account Suspension

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or harm other users.

4. Seller Terms

4.1 Listing Items

• You must own or have the right to sell all items you list
• All listings must accurately describe the item's condition, authenticity, and any defects
• You must not list counterfeit, stolen, or illegal items
• You must honor the price and terms stated in your listing

4.2 Commission Structure

My Hero charges ZERO commission on sales. Sellers keep 100% of the sale price. Buyers pay a small protection fee (50p + 5% of sale price) which is used to provide buyer protection services.

4.3 Payouts

• Sellers must connect a Stripe account to receive payments
• Funds are held in escrow until the buyer confirms receipt or 48 hours after delivery
• Payouts are processed to your bank account within 2-3 business days after release
• You are responsible for any taxes on your earnings

4.4 Shipping

• Sellers must ship items within 3 business days of receiving payment
• Sellers must use tracked shipping methods
• Sellers are responsible for packaging items securely to prevent damage
• Shipping costs are paid by the buyer separately from the item price

5. Buyer Terms

5.1 Purchases

• All sales are final once payment is processed
• You agree to pay the stated price plus buyer protection fee and shipping
• You must confirm receipt of items within 48 hours of delivery

5.2 Buyer Protection

You are protected if:

• Your item doesn't arrive
• The item significantly differs from the description
• The item arrives damaged (when properly packaged by seller)
• The item is counterfeit

Buyer protection does not cover buyer's remorse, minor differences in color/appearance, or damage caused by buyer misuse.

6. Payment Processing

All payments are processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms of service. We do not store your full payment card details.

7. Dispute Resolution

7.1 Communication

We encourage buyers and sellers to communicate through our messaging system to resolve issues directly.

7.2 Platform Mediation

If direct communication fails, contact our support team. We will review evidence from both parties and make a fair determination. Our decision is final.

7.3 Refunds

Refunds are issued at our discretion based on the circumstances and our buyer protection policy. If a refund is approved, funds will be returned to your original payment method within 5-10 business days.

8. Prohibited Activities

You must not:

• List or sell counterfeit, illegal, or stolen items
• Manipulate prices or engage in price fixing
• Create multiple accounts to circumvent restrictions
• Harass, threaten, or abuse other users
• Attempt to complete transactions outside the Platform to avoid fees
• Use automated tools to scrape data or create listings
• Engage in any fraudulent activity
• Violate any applicable laws or regulations

9. Intellectual Property

9.1 Platform Content

All content on the Platform (logos, design, text, graphics) is owned by My Apps UK and protected by copyright. You may not copy, reproduce, or distribute our content without permission.

9.2 User Content

You retain ownership of content you post (listings, messages, reviews), but grant us a license to use, display, and distribute your content on the Platform for operational purposes.

10. Reviews and Ratings

• Reviews must be honest and based on actual transactions
• You may not post fake reviews or manipulate ratings
• If no review is left within 48 hours of confirmed delivery, an auto-generated "Transaction completed successfully" review will be created
• We may remove reviews that violate our policies

11. Badges and Reputation

Sellers earn badges based on total completed sales:

• Hero Badge: 10 sales
• Super Hero Badge: 25 sales
• Hero Platinum Badge: 50 sales
• Super Hero Max Power Badge: 100+ sales

Badges are automatically awarded and cannot be manipulated. Special badges may be assigned by administrators for community contributions.

12. Limitation of Liability

My Hero acts as a marketplace platform only. We are not responsible for:

• The quality, safety, or legality of items listed
• The accuracy of listings or user-provided information
• The ability of sellers to complete sales
• The ability of buyers to make payment
• Delays or failures in shipping
• Disputes between users

To the maximum extent permitted by law, our total liability is limited to the amount of fees you paid to us in the past 12 months.

13. Indemnification

You agree to indemnify and hold harmless My Apps UK, its directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these terms.

14. Privacy

Your use of the Platform is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect and use your information.

15. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify users of significant changes via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the new terms.

16. Termination

Either party may terminate this agreement at any time. Upon termination:

• You must complete any pending transactions
• Your access to the Platform will be revoked
• Provisions regarding liability, indemnification, and intellectual property survive termination

17. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Buyer Protection Policy, constitute the entire agreement between you and My Apps UK regarding use of the Platform.
